Under Colorado law, a person is considered to be impaired by alcohol if he or she has a blood alcohol content (BAC) of .08 percent or higher. However, there are other ways to judge impairment under the law. Driving while ability impaired, or DWAI, means operating a vehicle after consuming enough drugs or alcohol to affect one’s physical or mental ability to drive to the slightest degree.

DWAI charges may arise when a person’s BAC exceeds .05 percent, but is less than .08 percent, or when a person has consumed drugs that affect his or her ability to drive. DWAI is a less serious offense than DUI, but it still carries substantial penalties, including fines, jail time and community service.

Convictions of a first-offense DWAI will result in a mandatory minimum two days in jail, with a maximum of 180 days and a possibility of a suspended license. You will also face fines from $200 to $500.
